1. Introduction

Terra Mater Factual Studios GmbH, Wambachergasse 2, 1130 Vienna, Austria (hereafter “TMFS”) respects the privacy of every User who visits this Website. This Data Protection and Privacy Policy outlines the information TMFS may collect and how it may use that information.

This Data Protection and Privacy Policy (“Privacy Policy”), together with the Terms and Conditions of TMFS, explains how TMFS uses User’s personal information and data collected from the Website and User’s rights in respect of such information and data. Capitalised terms which are used in this Privacy Policy have the meanings given to them in the Terms and Conditions of TMFS.

Personal information provided by Users or gathered by TMFS is controlled primarily by TMFS as data controller pursuant to the Datenschutzgesetz 2000 (Data Protection Law Austria, 2000).


2. What information does TMFS collects from Users?

TMFS collects and processes the following information about Users:

  • information provided by Users on registration, such as User’s name, organisation, phone number, email, address;
  • information TMFS learns about Users from their use of the Website and Content and Services offered by TMFS;
  • details of any transactions Users carry out through the Website; and
  • information Users provide when giving TMFS feedback.


3. For what purposes does TMFS use the information collected?

TMFS uses personal information collected from Users for the following purposes:

  • to deliver and provide TMFS’s Content and Services;

  • to research TMFS’s Website, Content and Services;

4. How does TMFS store and when does TMFS transfer User’s personal information?

All personal information that Users submit via the Website is sent to and stored on secure servers located in the European Union. Information submitted by Users may be disclosed by TMFS to other companies within the Red Bull Group and/or to the third parties mentioned in the circumstances described below, which may be situated outside the European Union and/or may be processed by staff operating outside the European Union. 5. Disclosure of User’s information

TMFS may share the information TMFS collects among TMFS-affiliated companies at home and abroad including TMFS partners, joint ventures and with any future owners of the Website.

TMFS may from time to time employ other companies and individuals to carry out functions on TMFS’ behalf including delivering services, sending mail, providing marketing assistance, analysing data, providing customer service and for accounting and invoicing purposes. In order to carry out their functions these companies and individuals may require access to User’s personal information but TMFS shall only disclose such relevant personal information as is needed by them to perform their functions.

Whilst TMFS take measures to safeguard the personal information that Users provide to TMFS, no transmission over the Internet can ever be guaranteed secure. Consequently, please note that TMFS cannot guarantee the security of any personal information that Users transfer to TMFS over the Internet.


6. Tracking Software and Cookies – What are they and how does TMFS use them?

TMFS may use TMFS’ own and third party tracking software to help TMFS analyse User’s use of the Website, Content and Services. Such analytical tools use cookies which are text files placed on User’s computer’s hard drive by the Website that collects certain information and data about Users and User’s visits to the Website, such as User’s IP address, browser type, the time and length of User’s visit, the pages of the Website Users visit and other clickstream data. Using this information enables TMFS to tailor Services to Users and make User’s use of the Services more user-friendly and efficient.

Google Analytics

is one of the tracking software TMFS use, a web analytics service provided by Google, Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ). Google Analytics also uses “Cookies”. The information generated by the Cookie about Users’ use of the Website (including Users IP- address) will usually be transmitted to and stored by Google on servers in the USA. In case of the activation of IP-anonymisation on TMFS’s Website though, User’s IP-address will be shortened by Google within a member states of the European Union or within other states that are parties to the European Economic Area Agreement. Only in exceptional cases will User’s IP-address be fully transferred to a server of Google in the United States and be shortened there. Google will use this information on TMFS behalf for the purpose of evaluating User’s use of the Website, compiling reports on Website activity for Website operators and providing other services relating to Website activity and internet usage. Google will not associate User’s IP-address with any other data held by Google. 7. Users rights

Users have the right to obtain a copy of processed personal information and data held by TMFS about Users. Users also have the right to ask TMFS to update and correct any out-of-date or incorrect personal information that TMFS hold about Users. 8. Third party sites and hyperlinks

TMFS sometimes provide hyperlinks and/or advertisements to other Websites that are not owned or controlled by TMFS. Please note that this Privacy Policy only applies to the personal information that TMFS collect through the Website and TMFS cannot be responsible for personal information that third parties collect, store and use through their Website. In submitting Personal User Data, the User warrants that he or she is not less than sixteen years of age. TMFS does not intend to collect any personal data from individuals under sixteen years of age, unless the child is at least thirteen and obtains the consent of their parent / guardian beforehand. Where appropriate, TMFS will specifically instruct children not to submit such information on TMFS’s Websites and/or will take reasonable steps to ensure parental consent to such submission.
